General Regulation of the Sporting Facilities

 

CHAPTER I

Background

 

Article 1


1 - The present Regulation may be applied to all the Sports Facilities, indoors or outdoors, associated to Centro Desportivo da Madeira (henceforth designated as CDM) under the guardianship of PONTA OESTE Sociedade de Promoção e Desenvolvimento da Zona Oeste da Madeira, S.A. (henceforth designated as Ponta Oeste).


2 - Considering the specificities of each Facility/Equipment and without counteracting the spirit of the present Regulation, Ponta Oeste may choose to establish utilization rules to render the Facilities/Equipments in consideration more lucrative.

 

CHAPTER II

 Management of the Facilities

 

Article 2

 
1 - All management of CDM’s Sports Facilities is carried out by Ponta Oeste.


2 - In special circumstances, Ponta Oeste may reach an agreement with other entities or Clubs, regarding their participation in the management of certain facilities, by means of signing utilization Protocols.

 

Article 3


As a manager, Ponta Oeste has the following responsibilities:

a) to manage the Facilities;
b) to attend to the requests for utilization of the Facilities and to classify them according to the priorities established in Article 6 of this Regulation;
c) to settle all cases of terms of equality in the cession requests and the omitted ones;
d) to set up a time chart for the Facilities;
e) to acquire all material deemed necessary for the proper functioning of the activities, and to secure its maintenance;
f) to establish the rules foreseen in clause 2 of article 1.

 

CHAPTER III

Utilization and Yielding of the Facilities

 

Article 4

 
1 - CDM’s Facilities operate weekdays, weekends and holidays from 09 a.m. to 11 p.m. Using the Facilities during nights, weekends and holidays will incur in an addition of 50% to the regular tariff.

Daytime: from 09 a.m. to 06 p.m.
Night-time: from 06 p.m. to 11 p.m.
Holidays and Weekends: from 09 a.m. to 11 p.m.

2 - The following days are an exception to the previous clause, when the Facilities are actually closed: 

    - 1st of January;
    - 1st of May;
    - 24th of December, from 12:30a.m.; 
    - 25th of December; 
    - 31st of December, from 06 p.m.

3 - During holidays, the Facilities work during the following schedule: from 09 a.m. to 11 p.m.


4 - Given the specificity of each Facility and considering certain times of year, different schedules may be arranged, observing nonetheless, the limits set on clause 1.


5 - On duly justified occasions, the President of Ponta Oeste may authorize the use of the facilities on schedules diverse from those established on the previous clauses.

 

Article 5


1 - There are three different types of utilization of the Facilities: 

    a) Regular, for a continuous and planned utilization of the sporting spaces throughout a season or period, by means of arranged agreement. 

    b) Casual, for a prompt utilization of the Facilities.

    c) Traineeships, for a utilization of the sporting spaces during a short or medium period of time.

2 - The regular utilization of the Facilities is granted through protocol agreement with Schools, Clubs and Associations that have organized sporting activities and statutes approved by law. 

    a) To all intents and purposes of the present Regulation, one considers as Regular Activities curricular classes, school sports, training and recreation activities, trainings and games which integrate federate competition boards.

3 - The casual utilization of the facilities is granted to the prompt activities of clubs, tournaments, trainings and other sporting activities organized by Clubs, Associations, Federations, and other entities or groups of individuals.


4 - Utilization of the facilities for traineeships is granted to entities, Clubs, Associations or Athletes who promote or conduct such traineeships, with the intent of preparing / training those athletes / clubs.
To all intents and purposes, one considers three days as the minimum length of duration for the activity.

 

5 - All requests for regular utilization of the facilities must be addressed in writing, obeying the deadline Ponta Oeste establishes for each area, and should contain the following data; 
    a) Identification of the petitioner; 
    b) Identification of the technicians in charge; 
    c) Modalities intended to be practised; 
    d) Utilization time, pointing out at which days and hours; 
    e) Period of annual utilization; 
    f) Average number of partakers.

6 - The regular user entity of the facilities should inform, in writing and two weeks ahead of time, if, for some reason, they must interrupt or cancel utilization of said facility.

 

7 - The user entity shall be removed of its rights of utilization if, without any justification, it does not use the facilities for a period of two consecutive weeks.

 

8 - a) All requests for casual utilization of the facilities must be made out in writing and five days ahead of time, whenever coming from Clubs, Schools, Associations or Federations. 
    b) All requests for casual utilization of the facilities coming from individuals or non-organized groups of individuals may be made out on the very day or within a maximum of three days ahead of time.

9 - All requests for Traineeships must be made out in writing, in the maximum advance and should contain the following data; 
    a) Address and identification of the petitioner;
    b) Identification of the Club/Federation; 
    c) Modalities intended to be practised;
    d) Utilization time and date; 
    e) Identification of the technicians;
    f) Name of the partakers

 

Article 6

 
1 - All requests for utilization of the Facilities will be classified according to the following priorities:

1.1 - Main Field, Artificial Field, Athletics Track, 5-a-side Football Field, Sports Complex, Paddle and Tennis Courts;

    a) Weekdays: 
      From 09 a.m. to 06 p.m. (Schooldays)
      - Clubs with regular activities entering for federate competition events;
      - Traineeships;
      - Clubs with regular activities;
      - Elementary Schools, Grammar Schools and Colleges;
      - Others.

      From 06 p.m. to 11 p.m.:
      - Clubs with regular activities entering for federate competition events;

      - Clubs with regular activities;
      - Others.


    b) Saturdays, Sundays and Holidays: 
      - Official competitive games ;
      - Clubs with regular activities;

      - Traineeships; 
      - Others.

 

Article 7


1 - All permissions for utilization of the Facilities will be imparted to the interested parties, with detailed information concerning the yielding terms.


2 - Users will be informed, in writing, if for some exceptional reason the yielding of the facilities has to be cancelled at any time.


3 - Yielding of the facilities may also be cancelled for the reason of federate competitive games taking place or in the occurrence of sporting activities that carry a special interest for Madeira, in which circumstances the users concerned will be properly noticed 20 days ahead of time.


4 - Yielded facilities are not transferable.

 

Article 8


The facilities may be yielded to more than one user at the same time, as long as there are technical conditions that allow it and provided that no harm will occur to the respective activities.

 

Article 9


1 - Whenever users come in group or groups, they should be escorted by someone responsible who must identify himself before the staff and who shall be held responsible for any irregularity or damage caused by the aforementioned users.

 

2 - Users are not allowed to use any other sports areas than those requested for.


3 - Only properly identified users and person or persons in charge shall have access to restricted sporting areas, and they must also wear appropriate footwear.


4 - All users must conduct themselves in an appropriate way so that they do not disturb other users’ activities in the same facilities.

 

Article 10


1 - In situations of trainings or classes, users are allowed to enter the changing-rooms 15 minutes ahead of time and they should vacate those 15 minutes after the end of the activity.


2 - During official competitions, users are allowed to enter the sports facilities 90 minutes ahead of time and the changing rooms must be left vacant 30 minutes after the end of such activities.


3 - Whenever it does not escape our notice that a user remains longer than allowed in the facilities, after the end of an activity, he shall be charged an additional fee, proportional to the overstay, according to the established price per hour for the facility in use.

 

4 - Users are solely responsible for any objects, valuables or any other belongings left in the changing rooms.

 

Article 11


It is strictly forbidden to smoke in all sports areas and in any supporting indoor facilities.

 

Article 12


The user is responsible for any damage caused during the time he used the facilities.

 

Article 13

 

1 - It is the responsibility of the organizing entity of the said events to ensure the security in the activities taking place in CDM, and CDM will, therefore, decline any responsibility in this matter.


2 - Notwithstanding, the organizing entity must confirm to CDM, as early as 24 hours before the beginning of the event, that they have everything set security-wise.

 

Article 14

 

Spectators in CDM must take the places designed for general public in all sporting events.

 

Article 15

 

1 - The management reserves the right to refuse admission.

 

2 - Among others, CDM reserves the right to not allow anyone who shows signs of improper health and hygienic conditions in their facilities.

 

Article 16

 

Objects strange or irrelevant to sports practise will not be allowed nor tolerated in the areas reserved for sporting activities.

 

Article 17

 

Eating in the areas reserved for sports practise is not allowed.

 

CHAPTER IV

Sports Equipments

 

Article 18


All sports equipments and apparatus among the facilities’ equipments are designed to support the users’ activities and may be requested for in the proper form and in the following beforehand:

1 - The day before utilization, whenever regular activities are concerned;


2 - On the very day the facility is booked for, whenever casual activities are concerned;


3 - Exceptionally, sports equipments may be requested for at the beginning of or during the activity, even though unnecessary delays may derive from this situation. 

 

Article 19

 

Using of the equipments referred in the previous article is limited by the utilization period of the respective facilities.

 

Article 20

 
1 - Whenever using the equipments implies that they have to be assembled and disassembled, these actions are the users’ responsibility, and must be done under the supervision of a member of the staff.

 

2 - Assembling and disassembling must be done during the time the user is allowed to utilize the facilities and in such a way as not to disturb the activities of any other users, those who will be there before and after his activity.

 

Article 21

 

1 - All areas assigned to equipment storage are off-limits to users.


2 - The situations described in the first clause of article 15 are the exception to the previous clause.

 

Article 22

 

1 - All sports equipment of collective usage is the legal property of Ponta Oeste and is, therefore, confined to its premises, where it cannot be removed from without higher authorization.


2 - Sports equipment belonging to Schools, Clubs or to any other entities may be stored in the facilities, as long as there is enough room for it.


3 - The equipment referred in the previous clause may be used by all users present at the facilities, unless its rightful owner specifically says otherwise.

 

Article 23

 

Only corresponding sports materials and equipments are allowed to use in each of the activities taking place in the respective areas, always observing the proper rules of each sport.

 

CHAPTER V

 Financial Policy

 

Article 24

 
The sporting facilities referred to in the present Regulation are financially supported by Ponta Oeste, who, in turn, will receive any revenue or profit deriving from its utilization.

 

Article 25


1 - Ponta Oeste has jurisdiction over the establishment of user fees.


2 - Ponta Oeste Council of Administration may, exceptionally and whenever there are justified reasons for it, authorize a certain space to be used, free of charge.

 

Article 26


1 - All regular utilization costs must be settled in the following month (after utilization).


2 - The non-observance of that rule may imply interdiction from the facilities until bills are settled.

 

Article 27


All entities or groups that attend the facilities in a casual way must pay its respective fees, on the occasion of booking them.

 

Article 28

 
1 - Our services may demand a security payment of up to 25% of the foreseen value from Entities, Clubs and Associations that intend to book the facilities for traineeships.


2 - Traineeship user fees must be settled at the beginning of such events, after the respective access cards have been issued.


2.1 - As exceptions to clause 2 are the reservation costs made by Travel agencies, that work on a regular basis with the Sports Centre, and whose payment will be settled during the month following the utilization.

 

Article 29


In case of non-attendance in scheduled activities, the entity responsible for such activity will bear the expenses corresponding to the utilization.

 

Article 30


Whenever a scheduled activity fails to take place for reasons unknown by the user or that are not under his control, he will not have to pay any utilization fees corresponding to the interruption period.

 

Article 31

 

When facilities are used for sports events, shows or any other activities that imply entrance fees and that may consequently produce financial profit for the user, permission will be granted through a specific Protocol.

 

Article 32


Permission for the use of advertisements within the facilities falls into the jurisdiction of Ponta Oeste.
